PREAMBLE

1. These general terms and conditions of sale (GTCS) are agreed between Fábrica do Santuário de Nossa Senhora do Rosário de Fátima, whose contact details are made available, hereinafter referred to as “Shrine of Fatima”, and any person wishing to make a purchase from the website www.store.fatima.pt, hereinafter referred to as “the User”.

2. These terms and conditions are thus exclusively applicable to natural persons who are not traders, these being understood as any natural person acting for purposes which are outside his professional activity.

3. The Parties agree that all purchases done through the website shall be governed solely by this contract, to the exclusion of all other terms and conditions previously made available.

ARTICLE 1 - OBJECT

1. The following GTCS have as their object to make available and define all the information necessary for the User about the modalities of order, sale, payment and delivery of the purchases made on the Shrine of Fatima Official Store website.

2. The following GTCS shall not apply whenever it is found, by the type of order, that the User is not the final consumer as defined in the subparagraph c) of Article 3 of Decree-Law No 24/2014 of 14 February.

ARTICLE 2 - ORDERS

1. The User can place orders through the purchasing process designated on the Shrine of Fatima Official Store website as “complete order”, after having used the online device and selecting “shop” from the existing catalogue.

2. Alternatively, the User may place his order through our phone number 249 539 690 or by email: store@fatima.pt, giving the particulars needed for the sale and delivery.

3. To place the order the User must:

  • “log in” with the e-mail and password chosen by the User when registering;
  • or register on the website providing the information requested (for further information please refer to No. 2 of Article 10 of these GTCS)
  • or make a purchase without compliance with any registration on the website, giving only the particulars needed for the checkout.

4. The orders are immediately processed, and any extras added to the order will be considered a new order and, accordingly, shall be subject to all the other applicable conditions.

5. When sending the order, the User shall be deemed to have fully accepted all the prices, description of the products available for sale as well as the GTCS, which are the sole applicable to the contract thus concluded.

6. The Shrine Official Store will honour the orders received within the limit of stock available. In case of product unavailability, the Shrine Official Store shall undertake to inform the User as soon as possible, within a maximum of 30 (thirty) days.

7. In case the User decides to wait for the product(s) to be available, he should use the contacts made available to express his willingness, within a maximum of 30 (thirty) days of acknowledging the unavailability.

8. The data in the invoice are entirely the responsibility of the User. After being issued, the invoice cannot be reissued with changes.

9.  Incoming orders are valid for 15 (fifteen) days, except if the order is registered under a promotional campaign establishing a different time limit: stocks, prices, discounts, promotions and offers are not guaranteed beyond this time limit. If the payment is not received by our services by that time, the order will not be validated. Any payment received after that time limit will be refunded.

ARTICLE 3 – DELIVERY

1. The Shrine Official Store provides 03 (three) types of dispatch for your order. At the checkout the User can select from different types of dispatch, according to the type and weight of the order and the place of delivery.

2. The data provided are computer processed, and are to be used for sales processing, tracing of the products and parcel delivery (if applicable).

3. All products will be sent to the delivery address given by the User according to location and/or client option.

4. The delivery modalities and delivery times are set out in the table below:

5. Book orders with a total weight of more than 1.5 kg are considered other items. Orders of other items with a total weight of more than 30 kg require special care and a specific budget which should be requested to the Shrine of Fatima Official Store using the contact details made available.

6. An order which includes books and other products will be considered a generic product purchase, and the listed prices corresponding to publications’ delivery does not apply.

7. Delivery times are merely indicative, based on the track record of the supply chain, but the Shrine Official Store commits itself, except when the product is out of stock on the supplier, to deliver the ordered items within a maximum of 30 (thirty) days.

8. The Shrine Official Store will always endeavour to meet the delivery times, but will inform the User of any difficulties to meet the estimated delivery times, providing the User the right to terminate the contract. If the User doesn’t exercise this right, we will assume that he is still interested in the order and allows the delivery to be made beyond the referred delivery time.

9. To estimate the overall delivery time until the User receives his order, consider the following equation:

10. The time counting begins when the payment of the order is successfully made. Orders made during the weekend and public holidays will only be processed on the next working day. The parcels are collected by the transport company until the end of the working day following the day of the payment successfully made.

11. The availability is the period of time in which the parcel becomes ready for dispatching. In an order of 2 (two) or more items with distinct availabilities, the longest period of time should always be considered. The availability is only guaranteed for one unit of each item and is always subject to the existing stock at the moment we receive the information that the payment was successfully made.

12. The total weight of the order includes the sum of the items acquired and their necessary packaging material.

13. The referred delivery modalities can vary according to the selected items and the chosen method of payment, therefore the delivery times for some items may be superior to those described in each delivery modality. The time spent on customs clearance for orders delivered outside the EU is not foreseen.

14. In the domestic mail service from the Mainland to the Autonomous Regions the number of days for the delivery may be extended according to the mode of transport used.

ARTICLE 4 – PAYMENT

1. The Shrine Official Store proposes the following methods of payment:

  1. Credit card (Visa, Mastercard, American Express and Discover);
  2. ATM cards (Debit card);
  3. MB Way;
  4. Paypal.

2. The User will make a lump sum payment corresponding to the costs incurred in order processing; additional charges incur in fixed costs such as cost-sharing packaging and postage costs.

3. The User has 15 (fifteen) days to pay for the order. If payment is not successfully made within 15 (fifteen) days, the order is cancelled.

4. In case of payment by credit card, the purchase is automatically deducted from the User’s credit card at the time the order is registered.  If any ordered items are out of stock, their value will be credited to the same credit card after placing the order.

5. In case of payment by ATM cards (Debit card) or MB Way the delivery will only be ensured after the payment has been confirmed, within a maximum of 24-hour after payment.

6. In case of payment in cash regarding cash on delivery transactions, only payments in Euro are accepted.

7. After we confirm that the payment has been successfully made, and within 24 (twenty-four) hours maximum, an e-mail will be sent confirming the validation of the order. The e-mail will be sent to the e-mail address indicated by the User when registering on the website.

8. In case of any difficulties using any of these methods of payment, please contact the Shrine Official Store.

9. For tax purposes, all orders are considered intended for the final consumer.

ARTICLE 5 – PRICES

1. All prices are in € (Euro), including charges and taxation according to the type of product, considering the VAT (Valued Added Tax) at the rate in force at the time of the order confirmation. The values referred in the shop windows and posters correspond to the price set or recommended by the publisher and to the retail selling price (RSP) on the Shrine Official Store website, the latter calculated according to the promotional discounts in force (to learn more about prices and discounts check out Article 6 of these GTCS).

2. In case there is a change in the listed prices of the items for sale on this website, unrelated to the Shrine Official Store, prices will be updated. If this situation should occur with any item of an order, and should it imply an increase in the price, the User will be informed, and may choose between receiving his order (paying the shortfall) or proceeding to its cancellation.

3. The listed prices displaced in the checkout process are always the most up-to-date retail prices in force; however, they should only be regarded as valid as long as they are displayed on the website in a refreshed page (cache or unrefreshed pages can display outdated prices). The displayed price is only guaranteed in these conditions and only after the order is registered and paid according to the payment terms included in these GTCS (No. 9 of Article 2).

4. Postage costs vary according to the weight of the order, the place of delivery and the delivery modalities (standard or express) selected by the User. To find out the costs of delivering an order, the User should add to the shopping cart the items he intends to buy and proceed to the checkout, confirming the value of the postage costs.

ARTICLE 6 – DISCOUNTS

1. There are several promotional price proposals on the website, as percentage discounts on the RSP, which are displayed in several pages, namely, in product posters, shop windows and search results lists.

2. All promotions are limited in time. To find out the promotional period of the promotions displayed simply go to the product poster.

3. Promotional discounts represent a commitment over a given period of time, but always on condition that the order is finalized through the checkout process and paid by the User by the end of the promotional period.

4. Unless otherwise indicated, in case of deferred payments, such as ATM cards (Debit card), the Shrine Official Store guarantees the discounts if the payment takes place within 8 (eight) days of concluding the checkout process.

5. Saving products in the shopping-cart does not ensure the price nor the discount.

6. Free postage costs for deliveries in:

  1. Portugal:
    1. Books - On orders over a total amount of 15€;
    2. Other items - On orders over a total amount of 50€.
  2. Internacional Europe:
    1. Books - On orders over a total amount of 75€;
    2. Outros produtos - Encomendas de valor total superior a 250€.
  1. Internacional Worldwide
    1. Books – On orders over a total amount of 150€;
    2. Other items - On orders over a total amount of 400€.

7. For orders that don’t meet these requirements, the postage costs in force shall be applied (see No. 5 of Article 5). Free postage costs are valid only for orders up to 5 kg and 150 cm long.

 

ARTICLE 7 – RIGHT OF WITHDRAWAL AND WARRANTIES

1. Any purchase order contract created on the Shrine of Fatima Official Store website may be freely terminated in accordance with Article 10 of Decree-Law No 24/2014 of 14 February, and the User shall bear the return costs. For this purpose, the User must return his order within 14 (fourteen) days of receiving the order, notifying our customer service using the contact form.    

2. The return should be made along with the document available in electronic form after the User has contacted the Shrine Official Store. The return process is simple but will vary according to the provenance of the order, and therefore the User should previously contact the Shrine Official Store using the contact form.

3. The Shrine Official Store doesn’t accept any return obliged to collect on delivery or against refund, and commits to refund the User within 14 (fourteen) days of receiving the notification where the User expresses the will to withdraw from the contract, in accordance with Article 12 of Decree-Law No 24/2014 of 14 February, or the working day following the receipt of the returned item or of the receipt that proofs the return, whichever is the latest.

4. Refunds of payments will be made through the same means of payment that has been used by the User in the initial transaction, or by bank transfer if the payment method used does not allow it.

5. The returned items are required to be in a suitable resale condition, i.e., a returned item must be in the same condition in which it was received, without malfunctions. The multimedia products must keep the corresponding inviolability seal, including the IGAC seal.

6. If the value resulting from an order item exchange is above the order’s initial value, the User will have to pay for the difference, through one of the available methods of payment in No. 1 of Article 4.      

7. If the value resulting from an item exchange is below the order’s initial value, or in case of return, the User may choose to have the refund of the value payed in excess by bank transfer, credited to an account specified by him.

8. Items sent as offers, like gifts and bonuses, shall not be refunded.

9. Within the present GTCS, the items purchased by the User are considered consumer goods, therefore the rules established by Decree-Law No 67/2003 of 8 April (Regime de garantia dos bens de consumo) shall apply mutatis mutandis.

 

ARTICLE 8 – COMPLAINTS

1. The User may submit a complaint to the Shrine of Fatima Official Store, located in Rua de Santa Isabel, 2495-424 FÁTIMA, or by electronic means, using the contact form.

2. The Shrine of Fatima Official Store provides all the necessary information to the User, allowing him to exercise his right of complaint with a public authority, a third neutral party, which will help settle any dispute. In case of dissatisfaction with the acquisition of a given item on our website and with the solution we have proposed to solve the situation, the User may go to the official website of the European Union https://webgate.ec.europa.eu/ and submit his complaint, or report directly to an Alternative Dispute Resolution (ADR) entity: CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, Faculdade de Direito da Universidade Nova de Lisboa, Campus de Campolide – 1099-032 Lisboa. 3. The User may also use the Electronic Complaints Book, which is a measure of the program “SIMPLEX + 2016”, involving the Direção-Geral do Consumidor and the regulatory agencies of different sectors.

 

ARTICLE 9 – liability

The Shrine Official Store shall not be liable for any inconvenience or damages caused to the User for the use of the Internet, such as service breakdown, intrusion attempts, and malfunctions due to viruses or any other case of force majeure.

 

ARTICLE 10 – PERSONAL DATA processing

1. Privacy statement and cookie policy: the processing of personal data is treated according to the Personal Data Protection Law in force. Please refer to our Privacy Policy for further information.

2. 100% secure shopping: the Shrine Official Store guarantees that all purchases on our website are secure, so you don’t have to worry with the safety of your credit card. All transactions are processed through a secure server with encrypted connections. At the Shrine Official Store, confidentiality of the personal data of our clients is a watchword that we wish to preserve. After we’ve used your card’s data for the payment of your order, they will be automatically erased from our data base and destroyed. In the next purchase, all your card’s data will be requested again.

 

ARTICLE 11 – INTELLECTUAL PROPERTY

1. All contents of the Shrine Official Store website are intellectual property of the Fábrica do Santuário de Nossa Senhora do Rosário de Fátima, and may not be copied or reproduced except when strictly necessary to allow online reading.

2. The contents on this website are produced by internal and external sources, therefore the Fábrica do Santuário de Nossa Senhora do Rosário de Fátima dismisses any lack of updating and/or lack of accuracy of that information.

3. All texts, pictures, illustrations, photos, trademarks and other elements of the Shrine Official Store website are protected by law.

4. The User that has a website and wishes, for personal use, to link for a redirection onto the Shrine Official Store website, must mandatorily obtain prior authorization from Fábrica do Santuário de Nossa Senhora do Rosário de Fátima.

5. In the latter case, this is not an implicit Affiliate Agreement.

6. All links to the Shrine Official Store website and using the framing or the in-line linking techniques are formally prohibited.

ARTICLE 12 – proof

The parties agree that the content of the computerised registers, stored in the computer systems of the Fábrica do Santuário de Nossa Senhora do Rosário de Fátima in reasonable conditions of safety, will be considered proof of communications, orders and payments between the parties.

ARTICLE 13 – storage and archiving of transactions

The orders and invoices are archived in a reliable and sturdy location, so as to retain a faithful and durable copy.

ARTICLE 14 – APPLICABLE LAW and COMPETENT COURT

1. The law applicable to any contractual relationship which is set out via the Shrine Official Store website is the Portuguese law.

2. To resolve any dispute or claim arising out of or in relation to any contract concluded under these General Terms and Conditions of Sale, Portuguese law will be applicable, with the Portuguese courts having exclusive jurisdiction, being competent to resolve any dispute, or, as an alternative, the aforementioned ADR entities, according to the conditions agreed upon by the parties.
